NOTICE OF INVITATION FOR COMPARATIVE PROPOSALS FOR THE DEVELOPMENT, MANAGEMENT AND OPERATION OF A MULTI-PURPOSE TRANSPORT TERMINAL PROJECT

Public notice is hereby given that the City Government of Batangas (City) received and accepted the Unsolicited Proposal of Batangas Ventures Properties and Management Corporation (BVPMC) the Original Proponent (OP) for the construction, development, operation and lease at its exclusive expense, of the 23,511 square meters property of the City covered by TCT No. 052-2014000222 and a deed of sale dated November 5, 2012 located along the diversion road of Barangay Alangilan, Batangas City for a new transport terminal and whereby the OP offered the adjacent properties leased for commercial and mixed-used purposes to complement the transport terminal, collectively called as the Multi-Purpose Transport Terminal (Project).  After completing detailed negotiations, the City is now ready to accept comparative proposals from developers.

The project is being undertaken by the City under a lease arrangement, which is a modality under Ordinance No. 3 S. 2013, otherwise known as BATANGAS CITY PPP CODE.

Interested developers must submit their notarized expression of interest (NEOI) to submit comparative proposals on or before June 22, 2015 at the City Planning and Development Coordinator (CPDC) Office, City Hall, Batangas City.

The notarized expression of interest (NEOI) with supporting documents must contain the following statement:

  1. The developer is a Filipino citizen or partnership wholly owned by Filipino citizens or a Filipino corporation at least 60% of its capital owned by Filipino citizens.
  2. The developer is financially and technically capable to undertake the Project and is capable to post the required proposal security bond.
  3. The developer has undertaken and completed similar project or project under PUBLIC-PRIVATE PARTNERSHIP (PPP).
  4. The developer shall undertake to adhere to all applicable City Ordinances, laws and policies and qualification criteria set by the City.
  5. The developer must be able to comply to the terms and conditions stated in the Terms of Reference (TOR) and Contract of Lease.
  6. The developer shall not in any manner prevent the Award of the Project and the carrying out the project.

 

Those who filed their notarized expression of interest (NEOI) on or before June 22, 2015 may obtain from the Office of the City Planning and Development Coordinator (CPDC) Office, City Hall a complete set of Tender Documents upon payment of a non-refundable fee of P 25,000.00. Only those who filed their NEOI on time and purchased copies of the Tender Documents shall be allowed to participate in this competitive selection procedure or open bidding.

The following schedule of activities shall be strictly observed:

  1. Publication of Notice of Invitation for Comparative Proposals in two (2) newspapers of general circulation and PHIL-GEPS . . .  June 8 and 15, 2015.
  2. On the first date of publication of the invitation for comparative proposal, the Private Sector Proponent (PSP) or Original Proponent (OP) shall post the proposal security or bid security equivalent to 2% of the development cost of the project – in cash, manager’s check or bank draft or 5% if surety bond.
  3. Posting of Notice of Invitation at the bulletin boards of the Batangas City, Provincial Capitol and Public Market . . . . June 8, 2015.
  4. Submission of Notarized Expression of Interest (NEOI) at the CPDC Office, City Hall . . . on or before June 22, 2015.
  5. Eligibility Check to short list qualified Private Sector Proponent (PSP) . . . June 23, 2015.
  6. Sending notice of eligibility or non-eligibility to PSP – – – – June 24, 2015.
  7. Release of Tender Documents . . . . June 29, 2015 to July 3, 2015 upon payment of the amount of P 25,000.00 in cash, manager’s check or bank draft.
  8. Pre-Selection Conference conducted by the PPP-SC at the CPDC Office, City Hall . . .  July 4, 2015 at 10:00 AM.
  9. Submission of Comparative Proposals (CP) at the CPDC, City Hall . . . . July 5 to July 16, 2015.
  10. Opening and Evaluation of Comparative Proposals (CP) . . . .  June 17, 2015 at the CPDC Office, City Hall.
  11. Within five (5) days from Opening and Evaluation of Comparative Proposals, the Original Proponent (OP) can exercise the Right to MATCH the superior or more advantageous comparative proposal.
  12. Issuance of NOTICE OF AWARD.

 

If no NEOI or comparative proposal is submitted, the Project shall be awarded to the Original Proponent (OP).

Further, pursuant to the above-mentioned Ordinance, the Original Proponent (OP) shall be given the right to match the superior offer or more advantageous offer to the City.

Furthermore, the PPP-SC reserves the right to (1) reject any and all applications for qualification and eligibility found not in conformity with aforesaid Ordinance or  with the requirements above-mentioned without incurring any liability to the affected Private-Sector Proponent; (2) waive any minor defect therein; and (3) accept the offer it deems most advantageous to the City Government.
